1. GENERAL INFORMATION
These Terms of Use govern access to and use of the BnCheck platform, a digital check-in automation system for accommodations and tourist apartments.
By accessing and using BnCheck, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you must not use our service.
2. DEFINITIONS
- Platform: Refers to the BnCheck website and services available at bncheck.com
- User/Host: Natural or legal person who uses the platform to manage bookings for their accommodation establishment
- Guest: Person who uses the digital check-in service provided by the host
- Account: User profile created on the platform to access services
- Service: Digital check-in management system and communication of data to competent authorities
3. ACCEPTANCE OF TERMS
By registering with BnCheck and creating an account, you confirm that:
- You have read, understood and accepted these Terms of Use
- You have legal capacity to contract (legal age or legal representation)
- The information provided during registration is true and accurate
- You undertake to comply with all applicable laws and regulations
Changes: We reserve the right to modify these terms at any time. Changes will become effective when published on the platform. Continued use of the service after changes constitutes your acceptance of the new terms.
4. REGISTRATION AND USER ACCOUNT
4.1. Account Creation
To use BnCheck, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining confidentiality of your access credentials
- Keeping your account, devices, second factor, access keys and active sessions secure
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Providing updated and truthful information
4.2. Accuracy of Information
You guarantee that all information provided is accurate, current and complete. False or misleading information may result in immediate suspension or cancellation of your account.
4.3. Account Security
It is your responsibility to keep your account secure. We recommend:
- Using strong and unique passwords
- Not sharing your credentials with third parties
- Properly enabling and safeguarding second factor or access keys when available for your account
- Logging out at the end of use, especially on shared devices
4.4. Team Accounts (Ultra Plan)
If your plan includes Teams functionality:
- The primary account may create and remove team accounts with dedicated credentials
- The primary account is responsible for reviewing team permissions and access
- Team accounts operate under the primary account context and do not acquire account ownership
5. ACCEPTABLE USE OF THE PLATFORM
5.1. Permitted Use
You may use BnCheck exclusively to:
- Manage bookings for accommodation establishments owned by you or under your responsibility
- Facilitate the digital check-in process for your guests
- Comply with legal obligations for guest registration under Spanish regulations
- Communicate data to competent authorities when required by law
5.2. Prohibited Use
It is strictly prohibited to:
- Use the platform for illegal or unauthorized purposes
- Attempt to access restricted areas or unauthorized systems
- Interfere with operation of the platform or servers
- Transmit viruses, malware or malicious code
- Impersonate another person or entity
- Collect information from other users through automated methods
- Use the platform for spam, unauthorized advertising or fraudulent activities
- Offer, resell, sublicense, commercially exploit or provide BnCheck as a service to third parties without express written authorization
- Create, maintain or use multiple accounts to bypass usage limits, security controls, billing, plan restrictions or platform protection measures
- Attempt to access, probe, compromise, intercept or test BnCheck systems, accounts, data, endpoints or infrastructure without express authorization
- Modify, adapt or create derivative works of the platform without authorization
- Reverse engineer software or attempt to extract source code
- Use the platform to manage unauthorized or illegal establishments
Consequences of non-compliance: Breach of these conditions may result in immediate suspension of your account, cancellation of service and, in serious cases, legal action.
6. SERVICES AND FUNCTIONALITIES
6.1. Service Description
BnCheck provides:
- Web platform for booking management and digital check-in
- Generation of unique links for guests to complete their data
- Digital forms for collecting guest data
- Automatic notifications of new bookings and check-ins
- Integration with the Ministry of the Interior accommodation system
- Management of multiple properties (depending on contracted plan)
- Team accounts with apartment-based permissions (available on Ultra)
6.2. Plans and Pricing
BnCheck offers different public subscription plans:
- Basic Plan: €4/month or €40/year plus VAT for 1 property with unlimited bookings, OCR, push and email notifications. Eligible accounts may include a 15-day trial with a payment card.
- Premium Plan: €10/month or €100/year plus VAT for up to 5 properties with unlimited bookings, advanced modules, push and email notifications
- Ultra Plan: €20/month or €200/year plus VAT for unlimited properties with unlimited bookings, Teams, and all functionalities
BnCheck is marketed as a B2B service for professionals, self-employed operators, and companies. All prices published or displayed on the platform exclude VAT. VAT or any other legally applicable indirect tax will be added according to the customer's location and tax status and shown on the corresponding invoice.
The Free plan is no longer offered as a new public plan. It may remain as an internal account state, an account without an active subscription, a blocked account, or a legacy grace period. Except for legacy users during an active grace period, Free accounts may have an operational limit of 0 bookings/month. Legacy users may temporarily keep the communicated limit during their grace period.
The Basic trial is granted only once per eligible account. It requires a payment method when started through Stripe Checkout. If a trialing Basic subscription is cancelled during the trial, Basic access ends immediately, the account returns to the applicable internal Free or blocked state, and no new Basic trial is granted.
Prices may be modified with 30 days' notice. Changes will not affect already contracted plans during the current billing period. If the user does not accept a change, they may cancel their subscription before it takes effect under the cancellation and termination section.
6.3. Service Availability
We strive to keep the platform available 24/7, but we do not guarantee uninterrupted availability. We may perform scheduled maintenance with prior notice where possible.
6.4. Communication with SES Hospedajes
BnCheck may facilitate the technical communication of traveler reports to SES Hospedajes or other competent official systems. This feature operates as a technical intermediary tool and does not replace the official SES Hospedajes system or the host's legal responsibilities.
- Host responsibility: The host is solely responsible for communicating data to SES Hospedajes and for the truthfulness, accuracy, completeness and currency of that data.
- Technical intermediation: BnCheck may prepare and transmit communications on behalf of the host when the integration is available, but it does not assume the legal registration obligation and does not replace the official SES Hospedajes procedures.
- Communication incidents: If BnCheck cannot communicate properly with SES Hospedajes due to technical issues, incorrect credentials, unavailability or changes to the official service, rejection of the communication, data errors or any other cause, the host remains responsible for submitting the communication through the corresponding official channels.
- Verification: The host must check that communications have been correctly accepted by SES Hospedajes and, where applicable, keep the official receipts or references generated.
- Deletion after acceptance: When SES Hospedajes confirms acceptance, BnCheck automatically deletes the local copy of guest identification, contact, document and stay data. Signature evidence is retained separately for up to 36 months together with the minimum operational metadata, including the SES batch number.
- Official retrieval: The SES batch number allows an authorized user to later request a query or PDF. BnCheck then obtains the data at that time from SES Hospedajes and processes it temporarily for the requested operation; the batch number does not mean that the deleted personal data is retained locally.
6.5. Informative Model (XBRL)
BnCheck provides a tool to generate supporting files related to Order VAU/1560/2025 and the current short-term rental regulatory framework. Royal Decree 1312/2024 was partially annulled by the Spanish Supreme Court judgment of 19 May 2026, so the user must verify the obligation applicable at each moment before submitting any information.
- Nature of the tool: This functionality is purely technical and generates a file based on user-entered data and existing records on the platform.
- Submission responsibility: BnCheck DOES NOT file or automatically submit this declaration to the Tax Agency or the Property Registry. It is the user's sole responsibility to download the generated file and submit it through the corresponding electronic office.
- Accuracy of data: The user is solely responsible for verifying that the data included in the generated file is correct, complete and up to date before submission.
- Liability disclaimer: Without prejudice to mandatory consumer rights under Spanish and European Union law, BnCheck assumes no liability for errors, omissions, inaccuracies, or outdated information in declared data, nor for incidents arising from telematic filing where such data or its validation depends on the user.
- Advice: BnCheck does not provide tax or legal advice. We recommend consulting a professional advisor to ensure proper compliance with your tax and registry obligations.
6.6. Traveler Report PDF
BnCheck may offer, in certain plans (Premium and Ultra), generation and download of a PDF copy of the traveler report.
- Tool nature: This is a support feature. For completed reports, BnCheck uses the retained batch number to retrieve the data from the official SES Hospedajes system and generate the PDF at that time.
- Legal use: The host must use and keep this copy only for booking management and legal compliance purposes.
- Time availability: Retrieval and download of completed reports may be limited to a maximum of 3 years after check-out, without this meaning that BnCheck retains the personal data locally after deletion following submission.
- Responsibility: The host is responsible for confidentiality and security of any copy downloaded outside BnCheck.
6.7. Virtual Assistant (Chatbot)
BnCheck may provide a virtual assistant inside the panel to answer operational questions about the platform.
- Technical provider: The service may run on Cloudflare infrastructure.
- Scope: The chatbot is a support tool and does not replace legal, tax, or professional advice.
- Responsible use: The user agrees not to share information in chat that is not necessary for the query.
7. USER RESPONSIBILITIES
7.1. Booking Management
As a host, you are responsible for:
- Correctly managing all bookings for your establishment
- Verifying guest identity according to applicable regulations
- Ensuring data provided by guests is accurate and complete
- Communicating data to competent authorities according to Royal Decree 933/2021
- Verifying that each communication to SES Hospedajes has been correctly accepted and submitting it through the corresponding official channels when BnCheck cannot complete it or when the communication is rejected
- Maintaining confidentiality of guest data
- Complying with all legal obligations related to accommodation
- Keeping your user account secure, including passwords, devices, second factor, access keys and active sessions
- Securely safeguarding any traveler report PDF copy downloaded from the platform
- Supervising access and actions performed by team accounts linked to your primary account
7.2. Guest Data
You guarantee that:
- You clearly inform guests about the processing of their data and the use of BnCheck as a technical tool or processor.
- You have a valid legal basis for processing guest data, which may be legal obligation, performance of a contract, legitimate interest or consent depending on the case; you must not present consent as the only basis where regulations require registration or communication.
- Data is processed in accordance with the GDPR, LOPDGDD, Royal Decree 933/2021 and any applicable tourism, contractual or local rules.
- You will not use data for purposes incompatible with the booking, accommodation, legal compliance or instructions provided to the guest.
- You will maintain security of data provided by guests
7.3. Truthfulness of Data Provided by the Guest
A guest who completes a traveler report declares that the data provided is truthful, accurate, complete and corresponds to their identity and documentation. If the guest provides false, incomplete, inaccurate, manipulated data or third-party data without authorization, the guest will be responsible for the consequences, damages, sanctions or claims arising from it to the extent permitted by law.
The host will not be liable for falsehoods or omissions exclusively attributable to the guest where the host acted in good faith, used the reasonable verification means available, and could not detect the falsehood or inaccuracy with ordinary diligence, without prejudice to any mandatory legal obligations applicable to the host.
7.4. Regulatory Compliance
You undertake to comply with:
- Royal Decree 933/2021 on guest registration
- Data protection regulations (GDPR and LOPDGDD)
- All laws and regulations applicable to the tourism sector
- Local regulations on accommodation establishments
8. INTELLECTUAL PROPERTY
8.1. BnCheck Ownership
All intellectual property rights over the BnCheck platform, including but not limited to:
- Software design, structure and functionalities
- Trademarks, logos and trade names
- Content, texts, graphics and images
- Source code and database
Are the exclusive property of BnCheck or its licensors and are protected by Spanish and international intellectual property laws.
8.2. Use License
You are granted a limited, non-exclusive, non-transferable and revocable license to:
- Access and use the platform according to these terms
- Manage your bookings and establishments
- Use functionalities included in your subscription plan
This license does not include the right to:
- Copy, modify or distribute the software
- Reverse engineer or decompile the code
- Use trademarks or logos without express authorization
- Create derivative works based on the platform
8.3. User Content
You retain all rights over data and content you enter into the platform. By using BnCheck, you grant us a license to:
- Process and store your data as necessary to provide the service
- Communicate data to authorities when required by law
- Use aggregated and anonymized data to improve the service
9. DATA PROTECTION
Processing of personal data is governed by our Privacy Policy, which forms an integral part of these terms.
Fundamental principles:
- BnCheck acts as controller for account, billing, security, support, own communications and cookies, and as processor for guest data processed on behalf of the host.
- While a communication is pending or has failed, guest data is kept encrypted for review or retry.
- After acceptance by SES Hospedajes, the local copy of guest personal data is automatically deleted; signature evidence is retained separately for up to 36 months together with the minimum operational metadata, including the SES batch number.
- Later queries or PDFs are generated by retrieving the information at that time from the official system using the batch number, without restoring a permanent local history of the deleted data.
- Unconfirmed bookings are ordinarily cleaned once more than 7 days have passed since the exit date (
exit_date)
- Data is processed only to comply with legal obligations and manage bookings
- We implement appropriate technical and organizational measures to protect data
- Team account access is scoped by permissions and assigned apartments
- The main server is located in Madrid (Spain), within the EEA
- Use of third-party services may involve international transfers under an adequacy decision, EU-US Data Privacy Framework, Standard Contractual Clauses and/or additional safeguards where applicable
- The chatbot may run on Cloudflare and temporarily retain conversation context to keep continuity of service
- We strictly comply with GDPR and Spanish regulations
9.1. Data processing agreement
Where BnCheck processes guest personal data on behalf of the host, the parties agree to the following processing terms under Article 28 GDPR:
- Controller: the host or entity that decides the essential purposes and means of guest data processing.
- Processor: BnCheck, to the extent it provides technical check-in, booking management, SES Hospedajes communication, document generation, support and limited retention services on behalf of the host.
- Subject matter and duration: processing necessary to provide BnCheck during the account term. Guest personal data remains while communication is pending or requires correction and is automatically deleted after acceptance by SES, without prejudice to the separate retention of signatures and metadata; after termination, the remaining deletion, blocking or retention periods apply.
- Nature and purpose: collection, encryption, storage, retrieval, technical communication, PDF or file generation, support, traceability, security and deletion of data related to bookings and accommodation obligations.
- Data and data subjects: identification, contact, document, stay, signature, technical metadata and minor data where applicable, relating to guests, hosts and team users.
- Instructions: BnCheck will process data only on documented host instructions, including service settings and these terms, unless a legal obligation requires otherwise.
- Confidentiality and security: BnCheck will apply confidentiality obligations to authorized personnel and reasonable technical and organizational measures, including encryption, access control, TLS, account segregation and technical security logs.
- Sub-processors: the host authorizes the use of providers necessary for infrastructure, payments, notifications, security, consented analytics and support, such as Vultr, Cloudflare, Google, Stripe and Meta where applicable. BnCheck will impose equivalent obligations and communicate relevant changes where reasonably possible.
- Rights and incidents: BnCheck will assist the host, as reasonable and taking account of the nature of the service, with data subject rights, security breaches, impact assessments and authority consultations.
- Deletion or return: the host instructs BnCheck to automatically delete the local copy of guest personal data when SES confirms acceptance of the communication. At the end of the service, BnCheck will delete or return the remaining data according to available functionality, unless legal retention, liability blocking or backup deletion cycles apply.
- Audit: BnCheck will make reasonable information available to the host to demonstrate compliance with this processing agreement. Audits must be requested with reasonable notice, respect confidentiality and not compromise security or other customer data.
10. PAYMENT PROCESSORS
For payment and subscription management we use specialized external providers:
- Stripe: Processes credit/debit card payments. BnCheck does not store or have access to your full card numbers. Use of Stripe is subject to its terms of service.
- Google Play Billing: Manages purchases made within the Android application. It is subject to the Google Play terms.
By making a purchase, you agree to the terms of service of the corresponding payment processor.
11. LIMITATION OF LIABILITY
11.1. Availability and Errors
BnCheck is provided "as is" and "as available". We do not guarantee that:
- The service will be available uninterrupted or error-free
- Results obtained will be accurate or complete
- Defects will be corrected
11.2. Exclusions of Liability
To the maximum extent permitted by law, BnCheck will not be liable for:
- Indirect, incidental or consequential damages
- Loss of profits, data or business opportunities
- Service interruptions due to causes outside our control
- Improper use of the platform by users or third parties
- Errors in data provided by users or guests
- Failure by the host to comply with legal obligations
- Problems arising from communication with third-party systems, including SES Hospedajes or the Ministry of the Interior accommodation system
- Rejections, errors, unavailability, changes, delays or inability to communicate with SES Hospedajes where they depend on credentials, data, validations, official third-party systems or any circumstance outside BnCheck's reasonable control
11.3. Host Responsibility
You are responsible for:
- Verifying accuracy of data provided by guests
- Complying with all legal obligations related to accommodation
- Correctly communicating data to competent authorities
- Directly submitting the communication to SES Hospedajes through the official channels when BnCheck cannot complete it properly or when there is no valid confirmation of acceptance
- Resolving any incident or claim related to your bookings
12. SUSPENSION AND CANCELLATION
12.1. By the User
You may cancel your account at any time by contacting us. Cancellation will be effective at the end of the current billing period.
12.2. By BnCheck
We reserve the right to suspend or cancel your account immediately if:
- You breach these Terms of Use
- You carry out illegal or fraudulent activities
- You provide false or misleading information
- You do not pay the fees corresponding to your plan
- You offer, resell, sublicense or provide BnCheck as a service to third parties without express authorization
- You create or use multiple accounts to bypass limits, security controls, billing or service restrictions
- You attempt to access, probe, compromise or test systems, accounts, data or endpoints without express authorization
- You compromise the security or integrity of the platform
12.3. Effects of Cancellation
After cancellation:
- You will immediately lose access to your account and data
- Data will be deleted according to our retention policy
- Fees already paid will not be refunded
- You must comply with all pending obligations
13. SERVICE MODIFICATIONS
We reserve the right to:
- Modify, suspend or discontinue any aspect of the service
- Update functionalities and features
- Change plans and prices with prior notice
- Remove obsolete functionalities
We will notify significant changes at least 30 days in advance when possible.
14. THIRD-PARTY LINKS
The platform may contain links to third-party websites, including the Ministry of the Interior accommodation system. We are not responsible for content, privacy policies or practices of third-party websites.
15. FORCE MAJEURE
We will not be liable for failure due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Wars, terrorism or civil unrest
- Failures in third-party services or infrastructure
- Changes in legislation affecting the service
- Strikes or labor disputes
16. APPLICABLE LAW AND JURISDICTION
These Terms of Use are governed by Spanish law. For any dispute arising from these terms or from use of the platform, the parties submit to the courts and tribunals of the user’s domicile, expressly waiving any other jurisdiction that might apply.
For consumer users, Spanish and European consumer protection legislation will apply.
17. DISPUTE RESOLUTION
17.1. Claims

17.2. Mediation
In case of disagreement, the parties undertake to attempt to resolve the conflict through mediation before going to court.
17.3. Alternative dispute resolution
The European Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. If you act as a consumer, you may use the complaint and alternative dispute resolution mechanisms applicable under current Spanish and European law.
18. GENERAL PROVISIONS
18.1. Entire Agreement
These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and BnCheck regarding use of the service.
18.2. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
18.3. Waiver
Failure to exercise any right under these terms does not constitute a waiver of that right.
18.4. Assignment
You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign these terms without restriction.
